Greece's transfer of building rights: 194 proposed zones and what owners could gain
Greek law has promised owners of listed buildings since 1979 that they could sell the floor space they cannot build. The 2026 planning code sets out how, but no buyer can use a title until receiving zones are approved by presidential decree.
13We read 13 sources, all in Greek, including the full text of articles 123–130 of law 5306/2026 in the Government Gazette, so you can read this in 5 minutes. What we checked ↓
Does this affect you?
- Holders of existing transfer-of-building-coefficient titles
- Titles issued under laws 880/1979, 2300/1995 and 3044/2002 that still have a balance can be registered in the pilot Digital Land Bank, which runs no later than 31 December 2026.23 A title can change hands only through the Bank, except by inheritance.1
- Owners of listed buildings, plots earmarked for public spaces, or plots in archaeological sites
- These are the properties the law says can offer floor space, and their owners can receive a title for the area they may not build.1 Nothing can be sold to a private buyer until a receiving zone is approved, by our reading of the law.1
- Owners and developers inside the proposed receiving zones
- Once a zone is approved by presidential decree, you could buy extra floor space at its value plus a 5% contribution.1 The zones reported so far are only proposals.5
- Residents of the North Athens sector and East Attica
- Ethnos says the first consultation round will cover these areas; on 20 October a local report said it was coming soon.59
What to do Nothing can be traded yet: by our reading of the law, a buyer needs an approved receiving zone, and the zones reported so far are only proposals.15 If you hold an existing title, you can register it in the pilot Digital Land Bank until the Bank is fully operating, and no later than 31 December 2026.23 If you own property in a proposed zone, watch for the public consultation, which has no announced date.5

At a glance
- Law 5306/2026 gives owners of listed buildings, plots earmarked for public spaces and plots in archaeological sites a title for the floor space they may not build, which they can sell only through ΥΠΕΝ's Digital Land Bank.18
- Buyers must own property in an approved receiving zone (ΖΥΣ), or certain State-owned land, in the same municipality or a neighbouring one in the same regional unit or region. They pay the value of the floor space plus a 5% contribution, paid into a Green Fund account for the receiving municipality.1
- Ethnos reported on 16 October 2026 that the ministry showed 194 proposed zones in 50 municipal units at a closed seminar. None has been approved, and on 24 October the public consultation was still described as a next step.58
Greek law can stop the owner of a listed building from building the floor space the plot would otherwise allow.1 Since 1979, the law has offered such owners a way to be compensated: they can sell that unbuilt floor space for use on another plot.1265 The current code calls this a right to "non-monetary compensation", in our translation.1 The tool is the transfer of building coefficient (Μεταφορά Συντελεστή Δόμησης, Metafora Syntelesti Domisis, or ΜΣΔ), and court rulings and missing implementing acts have kept it largely blocked since the 1990s.1011 In October 2026 the environment ministry showed the first proposed areas where that floor space could be built, according to the newspaper Ethnos.5
What is a transfer of building coefficient?
The rules are in articles 123 to 130 of the Spatial and Urban Planning Code, law 5306/2026, published in the Government Gazette (ΦΕΚ, Fyllo Efimeridas tis Kyverniseos) A΄ 88 on 8 June 2026.1 The Code defines a transfer as removing building coefficient from an "offering" property and adding it to a "receiving" property, in our translation.1 The offering owner receives a title for the buildable square metres that may not be built on the plot once an administrative act restricts building there.1 Titles are issued in the owner's name by ΥΠΕΝ, the Ministry of Environment and Energy (Υπουργείο Περιβάλλοντος και Ενέργειας, Ypourgeio Perivallontos kai Energeias).1 A title can be split, and it changes hands only through the Digital Land Bank (Ψηφιακή Τράπεζα Γης, Psifiaki Trapeza Gis), except by inheritance.1
Who can sell titles?
Article 126 of law 5306/2026 lists three kinds of offering property.1
- Land being expropriated to create public or community spaces, and land that higher-level planning reserves for public use or green space.1
- Property on which building terms or restrictions have been imposed under article 200 of the Code or similar provisions; press explainers describe this group as listed buildings and monuments.18
- Plots inside a town plan or settlement that are designated archaeological sites or historic places, where building is limited or banned.1
Forest land is not on the list in article 126.1
Who can buy, and where?
Under article 127, receiving properties lie in areas designated as receiving zones (Ζώνες Υποδοχής Συντελεστή, Zones Ypodochis Syntelesti, ΖΥΣ), plus State-owned properties for which approval of a Special Spatial Development Plan for Public Properties has been sought since law 4495/2017 took effect.1 A title can be used in the same municipality, or in a neighbouring municipality of the same regional unit or region.1 By our reading of articles 127 and 128, no private owner can buy floor space until a zone has been approved.1
How would the Digital Land Bank work?
Owners register both offering and receiving properties in the Bank, an online system run by ΥΠΕΝ.1 It matches them by the value of the floor space at objective property values on the day of registration, by order of registration, and by location, looking first in the same municipal unit, then the same municipality, regional unit and region.1 The buyer pays that value plus a contribution of 5% of the floor space's value as assessed for property transfer tax, which goes to a Green Fund (Πράσινο Ταμείο, Prasino Tameio) account for the municipality where the receiving property lies.1 Once the buyer pays, the transfer is registered at the land registry and the offering property loses that floor space for good.1
How are receiving zones approved?
Zones are approved by presidential decree on the minister's proposal, or set within local and special urban plans.1 Before a decree is issued, the law requires a strategic environmental assessment, a special planning study, opinions from the municipal or regional councils, and an opinion from ΚΕΣΥΠΟΘΑ, the Central Council for Urban Planning Issues and Disputes (Κεντρικό Συμβούλιο Πολεοδομικών Θεμάτων και Αμφισβητήσεων, Kentriko Symvoulio Poleodomikon Thematon kai Amfisvitiseon).1 Zones may not be placed in historic places, traditional settlements, archaeological sites, historic city centres outside regeneration areas, or blocks next to forest land, and each study caps the floor space a zone may receive.1 Ethnos reports that the Council of State (Συμβούλιο της Επικρατείας, Symvoulio tis Epikrateias, ΣτΕ), Greece's highest administrative court, will review the decrees before publication.5
Why has the scheme been stuck for so long?
In ruling 6070/1996, the ΣτΕ plenary, building on its rulings 1071–1073/1994, found transfer provisions of law 2300/1995 contrary to Article 24 of the Constitution, because floor space could go to areas not fixed in advance.1110 Law 3044/2002 rewrote the scheme, but the ΣτΕ plenary struck down its basic provisions in ruling 2366/2007.10 Law 4495/2017 barred the sale of titles, and law 4759/2020 restated the rules, but the implementing acts were not issued.1210 In ruling 1587/2024 the ΣτΕ upheld compensation awarded to title-holders, finding the State liable for failing to issue a joint ministerial decision required under law 3044/2002.13
What did the ministry present in October 2026?
Ethnos reported on 16 October 2026 that ΥΠΕΝ presented 194 proposed receiving zones in 50 municipal units at a closed ministry seminar.5 Ethnos and To Vima give the same regional split: 62 in the North Athens sector and East Attica, 55 in Central Macedonia, 32 in Crete, 12 in Magnesia, 11 in East Macedonia and Thrace, 6 in Central Greece, 6 in Patras, 4 in Nafplio and 4 in Kastoria.56 By our calculation, those regional figures add up to 192, not 194.56 To Vima and in.gr put 72.4% of the area of waiting titles in Athens and Thessaloniki.67 The studies were commissioned through ΤΕΕ, the Technical Chamber of Greece (Τεχνικό Επιμελητήριο Ελλάδας, Techniko Epimelitirio Elladas), under a December 2021 decision that set 30 June 2025 as the completion date.4
What happens next?
Ethnos says a public consultation with maps and data for each zone comes next, starting with the North Athens sector and East Attica.5 A local news site in Dionysos, a municipality in that area, reported on 20 October 2026 that its consultation would last two months, and that opposition councillors fear clashes with the local plan under way.9 The ΚΕΣΥΠΟΘΑ opinion, the presidential decrees and the ΣτΕ review would follow.51 To Vima and in.gr, two outlets of the same media group, report that the Bank is expected to be fully operating in early 2027, "barring new setbacks", in our translation.67
What can owners do now?
Holders of existing titles with a remaining balance, issued under laws 880/1979, 2300/1995 and 3044/2002, can register them in the pilot Digital Land Bank, set up by a joint ministerial decision published on 13 March 2026.2 Owners and engineers can register through gov.gr, which opened for registrations on 16 March 2026.2 The pilot runs until the Bank is fully operating, and no later than 31 December 2026.23 Owners in a proposed zone cannot yet buy floor space, and can comment once the consultation opens.15

What we checked
Highlights from our fact-check against the original Greek documents. Every claim in the article went through the same check.
- Got it wrong
To Vima's headline says the 194 proposed zones are in "50 δήμους", 50 municipalities.6
Ethnos, and To Vima's own text, say 50 municipal units (δημοτικές ενότητες), out of 84 units in the study programme. A municipality can contain several units.56
- Not in the document
Ethnos and To Vima report that the ministry presented 194 proposed receiving zones.56
The regional figures both outlets publish (62, 55, 32, 12, 11, 6, 6, 4 and 4) add up to 192 by our calculation. We could not see the ministry's own table to find the other two.56
- Confirmed
To Vima says matching should start within the same municipality, then a neighbouring one.6
The law limits use to the same or a neighbouring municipality of the same regional unit or region, and the Bank matches first within the same municipal unit, then municipality, regional unit and region.11
- Confirmed
Taxydromos lists owners of listed buildings, monuments, plots cut by the street plan and archaeological sites as those who can sell.8
Article 126 names expropriated or public-use land, property restricted under article 200, and archaeological sites or historic places in town plans. Forest land is not on the list.1
What we don't know yet
- Why the regional zone counts reported by Ethnos and To Vima add up to 192 (by our calculation), while both outlets give a total of 194. We could not read the ministry's own table: ypen.gov.gr blocked our requests.
- The full list of the 50 municipal units and the number of zones in each. Ethnos, To Vima and in.gr say the whole programme covers 84 municipal units; only Ethnos adds 42 municipalities.
- When the consultation on the zones will open, where it will be published and how long it will last. The two-month period comes from a single local report about Dionysos.
- How much floor space each zone may receive (the percentage cap in article 128, paragraph 6), and how that compares with the 428,602 m² of titles that, according to To Vima, are still waiting. Capital.gr reported the same 3,837 titles and 428,602 m² in August 2021, so it is unclear whether the count has been updated.[S6][S12]
- What an estimated 'supply' of about 16.4 million m² of building coefficient, reported by Ethnos and in.gr, actually measures.
- What happens to the pilot if the Digital Land Bank is not fully operating by 31 December 2026, the latest date the pilot decision allows. The 'early 2027' estimate comes from two outlets of the same media group.
- How older titles issued under laws 880/1979, 2300/1995 and 3044/2002 will be valued against today's objective values, and whether compensation claims like the one in Council of State ruling 1587/2024 will continue.
- Whether the 30 June 2025 deadline for the zone studies was formally extended.
- How long the presidential decrees and their review by the Council of State will take. No timetable has been published.
