Greece's Ministry of National Economy and Finance (Υπουργείο Εθνικής Οικονομίας και Οικονομικών, Ypourgeio Ethnikis Oikonomias kai Oikonomikon) has published a draft law that would change how bad loans are handled.[S1] It is only a proposal: public comments close on Thursday 22 October 2026 at 10:00, and the ministry aims to pass the bill in the first week of November.[S1][S3] Its debt chapter covers banks and, above all, credit servicers (διαχειριστές πιστώσεων, diacheiristes pistoseon), usually called loan servicers: the firms that manage bad loans.[S1][S9] Under law 5072/2023, servicers are licensed by the Bank of Greece (Τράπεζα της Ελλάδος, Trapeza tis Ellados), the central bank.[S8][S9]

## Restructuring requests would run to a timetable

The bill would replace the banks' Code of Conduct (Κώδικας Δεοντολογίας, Kodikas Deontologias) with a standard procedure for agreeing a restructuring directly with the lender, free for borrowers (article 227).[S1][S9] Once a loan is more than 90 days in arrears, the lender would have at most 60 days to tell the borrower about the procedure, and the borrower would then have two months to apply (article 229).[S9]

The lender would have three months to answer a complete application, and the whole process would have to end within six months (articles 229 and 232).[S1][S9] Where two solutions are possible, the lender would have to offer both, and any rejection would need written reasons.[S1][S9] If the lender missed its deadline, interest would be suspended until the lender answered, enforcement could neither start nor continue and the case would be reported to the Bank of Greece automatically (article 240).[S9] Once a complete application is in, the lender could not start enforcement against the borrower's main home (article 235).[S9]

## Down-payments would be capped at 15% of the principal

The ministry says creditors could ask for no more than 15% up front.[S1] The text is more precise: the offer "may contain a down-payment of up to 15% of the principal" (our translation), and the lender may waive or reduce it for hardship, social or health reasons (article 229).[S9] According to the ministry, down-payments had in several cases been more than 30% of the debt, and some had reached 50%.[S1]

## Offers before an auction would get a standard

Creditors already have to send a written restructuring offer at least three months before an auction, under article 182 of law 5193/2025; the ministry's summary presents this as new.[S1][S9] The bill would amend that rule (article 225).[S9] The offer would have to be suitable, sustainable and justified by the borrower's ability to pay and financial position, and it would have to leave the creditor no worse off than if the assets were liquidated.[S1][S9] Large companies would be excluded.[S9] Existing limits stay: the duty applies once, to the first auction, not to repeat auctions, and not to borrowers who have neither registered with the creditor's online information system nor answered a request for financial details.[S9]

## Borrowers who keep paying would be protected

While a borrower keeps to a restructuring, the creditor could not cancel it, obtain or enforce a payment order, seize assets, or start or continue an auction (article 222).[S1][S9] The same would apply to a borrower who missed payments only because the creditor failed to give the details needed to pay.[S9] Any such step would be void by law.[S1][S9] The borrower would be credited with five monthly instalments, and the restructuring would be extended by five months at no extra cost.[S1][S9] The creditor would also face an administrative fine of between €50,000 and €500,000.[S1][S9]

The fine would apply "per borrower", and it would be imposed by the ministry's General Secretariat for the Financial Sector and Private Debt Management (Γενική Γραμματεία Χρηματοπιστωτικού Τομέα και Διαχείρισης Ιδιωτικού Χρέους, Geniki Grammateia Chrimatopistotikou Tomea kai Diacheirisis Idiotikou Chreous), not by the Bank of Greece.[S9] A second breach within three years would cost at least double the first fine.[S9] After a third, the Bank of Greece could stop the firm from taking on new loans to manage for between one and twelve months.[S9]

## A free debt file within 45 days

Borrowers could ask a servicer for their contracts, their full payment history, how their interest is calculated and a breakdown of the debt (article 220).[S1][S9] The servicer would have to provide these free of charge within 45 days.[S1][S9] If it missed the deadline, or the file was incomplete, the debt would stop earning contractual and default interest until everything had been provided.[S9]

## Other proposals for borrowers

- Mediation through the Hellenic Financial Ombudsman (Ελληνικός Χρηματοοικονομικός Μεσολαβητής, Ellinikos Chrimatooikonomikos Mesolavitis) (article 241).[S1][S9]
- A cap on how far interest can grow an overdue debt, taken from article 39 of law 3259/2004.[S1][S9] It would apply automatically to all loan debts at least 90 days overdue, with no application needed.[S9] Lenders would have six months to recalculate those debts, and money already paid would not be refunded (article 221).[S9]

## What servicers would have to do

- Publish data every year on their finances (including dividends), governance, portfolios, results and complaint handling (article 212).[S1][S9]
- Send the Bank of Greece a yearly plan for managing the loans they handle (article 213).[S1][S9]
- For securitisations backed by a state guarantee or other public support, undergo a yearly independent audit of fees and expenses, and publish a summary (article 224).[S1][S9]
- Face Bank of Greece sanctions for missing, inaccurate or incomplete data, with the sanctions made public (article 217).[S1][S9]

## The 120 instalments are on a separate track

On 30 September the government announced that tax and social-security arrears could be paid in up to 120 instalments instead of 72, with a minimum instalment of €30.[S6][S7] The scheme would cover debts that fell overdue by 31 December 2024 and were not in a payment plan on 30 September 2026.[S6] Applications would be open until 30 June 2027, with interest at 5.84%.[S6][S7] It is not in the draft put to consultation: the ministry's summary does not mention it, and we found no such provision in the bill text.[S1][S9] None of the sources says which law will carry it.[S1][S6]
