# Greece's Brain Gain tax break: when the 50% relief ends and what the new 15% tax covers

Greece's Parliament passed a bill on 5 November 2026 that sets out when the 50% income tax break for people who move to Greece stops, with some rules reaching back to tax year 2021. The same bill taxes pensions from international organisations at a flat 15%.

## Does this affect you?

- **People already using the 5Γ tax break**: Under the tabled text, if you no longer meet the employment condition, the relief stops from the date your job ends, and if you also move your tax residence abroad, from that tax year. Both rules apply from tax year 2021.[S1]
- **People planning to move to Greece**: According to the press, leaving before you complete two years would cost you the relief back to your first year, for tax years from 2026; the bill summary speaks of losing the incentive if an obligation is not kept.[S1][S2][S3][S4]
- **International-organisation pensioners living in Greece**: Pensions paid by international organisations that Greece recognises would be taxed at 15% as a final tax, whatever your nationality; Ta Nea reports this starts in tax year 2027.[S1][S3]

**What to do:** Nothing changes until the law is published in the Government Gazette (ΦΕΚ); Parliament passed the bill on 5 November 2026.[S6] If you use 5Γ, check whether you still meet its employment condition, because the new rules tie the end of the relief to it.[S1]

## At a glance

- Article 5Γ of Greece's Income Tax Code exempts 50% of Greek-source pay or business profits from income tax for seven tax years for people who move their tax residence to Greece; the loan servicers bill Parliament passed on 5 November 2026 tightens it.
- Under the tabled text, relief stops from the date a job ends if the employment condition is no longer met, and from the tax year a person moves their tax residence abroad; both rules apply from tax year 2021. Leaving before two years costs the relief back to the first year, from tax year 2026, according to the press; the bill summary speaks of losing the incentive if an obligation is not kept.
- A separate article taxes pensions paid by recognised international organisations to Greek tax residents, of any nationality, at 15% as a final tax. This is not the 15% on profit-based pay in the 2027 tax bill.

Greece gives people who move their tax residence to the country a 50% income tax break for seven years, and on 5 November 2026 Parliament passed rules on when that break ends.[S1][S3][S6] The break sits in article 5Γ of the Income Tax Code (Κώδικας Φορολογίας Εισοδήματος, Kodikas Forologias Eisodimatos, or ΚΦΕ), and Greek reports call it the "Brain Gain" regime.[S3][S4] The changes are not in a tax bill: they are articles 302 to 304 of the omnibus bill on loan servicers and 120-instalment debt schemes, tabled on 26 October 2026.[S1][S2] We cover the rest of that bill in our [explainer on the loan servicers bill](https://agentnews.gr/work-money/greece-loan-servicers-bill-explained).

Parliament's plenary passed the bill on Thursday 5 November 2026.[S6][S7][S8] It becomes law only when it is published in the Government Gazette (Φύλλο Εφημερίδας της Κυβερνήσεως, Fyllo Efimeridas tis Kyverniseos, or ΦΕΚ); the report of the vote gives no law number, and we found no ΦΕΚ publication by 6 November 2026.[S6] We read the bill as tabled; the text Parliament passed may include technical changes that we have not seen.[S1][S6]

## What does the Brain Gain tax break give?

Article 5Γ exempts from income tax 50% of the pay or business profits a person earns in Greece, for seven tax years.[S3][S4][S5] It covers both employees and the self-employed.[S3][S5] The press list the main conditions: the person must not have been a Greek tax resident for five of the previous six years, must work or run a business in Greece, and must commit to staying in Greece for at least two years.[S3][S4][S5] Insider notes that the two-year commitment already applies.[S4]

> **50%**: Share of Greek-source pay or profits exempt from income tax under article 5Γ, for seven tax years.[S3][S4]

In April 2026, decision Α.1096/2026, signed jointly by a deputy finance minister and the governor of ΑΑΔΕ (Ανεξάρτητη Αρχή Δημοσίων Εσόδων, Anexartiti Archi Dimosion Esodon), the tax authority, changed the application rules so that people who work for the Greek state can also apply for 5Γ.[S10] We could not read the full current text of article 5Γ, so this summary of the conditions relies on the press.[S3][S4][S5]

## What happens if you leave Greece within two years?

The bill's summary says article 302 makes the 5Γ regime stricter and provides for loss of the tax incentive in paragraph 2 if the person does not keep the obligation the article sets out.[S2] Ta Nea and Insider report that anyone who does not stay in Greece for at least two years loses the exemption retroactively from their first tax year in the regime.[S3][S4] Newsbeast reports that the person's tax would then be recalculated, including on the 50% that had been exempt.[S5]

Article 304 of the tabled bill applies this rule, point (α) of the new paragraph 5 of article 5Γ, from tax year 2026 onwards.[S1] We have not seen the wording of point (α), so we cannot say whether interest or surcharges would be added.[S1]

## When does the relief stop if your job ends?

Point (β) of the new paragraph 5 says that a person who no longer meets the condition in point (γ) of paragraph 1 stops falling under article 5Γ from the date their employment relationship ends.[S1] Insider describes that condition as the employment condition, and reports that the end of the relief is now tied to the moment it stops being met.[S4] Insider and Newsbeast add that people can stay in the regime if they take a new job or start a business within 12 months; Insider says this is already the rule, and we have not seen that part of the tabled text.[S4][S5]

> Under the tabled text, a 5Γ user who no longer meets the employment condition loses the relief from the date the job ends.[S1]

Point (γ) covers a person who no longer meets that condition and also moves their tax residence abroad.[S1] For them, the relief stops from the tax year of the move, and from that year the first sentence of paragraph 2, where the bill summary places the tax incentive, no longer applies.[S1][S2] The tabled pages we read begin partway through paragraph 5, so we have not seen its opening words.[S1]

## Why do some of the rules go back to 2021?

Article 304 applies points (β) and (γ) of the new paragraph 5 from tax year 2021 onwards, while point (α), on leaving within two years, applies from tax year 2026.[S1] Insider and Newsbeast also report the 2021 start for the rule on jobs that end.[S4][S5] The parts of the tabled bill we read do not say whether ΑΑΔΕ will reopen past years for people whose job ended, or who moved abroad, since 2021.[S1]

## Who pays the new 15% tax on pensions?

Article 303 adds a paragraph 2.β to article 15 of the ΚΦΕ for pension income that arises abroad and is paid by international organisations that Greece recognises, that Greece has joined and whose accession has been ratified by law.[S1] These pensions, paid to the organisations' pensioners who are Greek tax residents, of any nationality, would be taxed at 15%.[S1] Paying that 15% would settle every tax obligation on that pension income.[S1] Ta Nea reports that the 15% applies from tax year 2027.[S3]

## Is this the same 15% as in the 2027 tax bill?

No. The tax bill tabled on 4 November 2026 has its own 15% rate, in article 10, on the part of profit-based pay to board members, managers and staff above €60,000 a year per recipient, which has nothing to do with pensions or with 5Γ.[S9]

## What should people using 5Γ do now?

Parliament passed the bill on 5 November 2026, but nothing changes until the law is published in the ΦΕΚ.[S6] People in the regime can check whether they still meet its employment condition, because under the tabled text the relief ends when that condition stops being met.[S1] We do not give personal tax advice, and the tabled text does not say how ΑΑΔΕ will apply the rules, especially for past years.[S1]

## What we checked

- **confirmed**: Ta Nea reports that pensions from recognised international organisations will be taxed separately at 15% from tax year 2027.[S3] → Article 303 of the tabled loan servicers bill sets the 15% as a final tax on these pensions, whatever the pensioner's nationality, but the transitional article 304 we read gives no start year for it.[S1] The 15% in the tax bill tabled on 4 November 2026 is a different rule, on the part of profit-based pay above €60,000 a year.[S9]
- **confirmed**: Ta Nea and Insider say the retroactive loss of the exemption applies from tax year 2026.[S3][S4] → Article 304 of the tabled bill applies point (α) of the new paragraph 5 of article 5Γ from tax year 2026.[S1] We have not seen the wording of point (α) itself; the bill summary describes a loss of the incentive if the obligation the article sets is not kept.[S2]
- **confirmed**: Insider says the relief stops from the time a taxpayer no longer meets the employment condition, from tax year 2021.[S4] → Point (β) of the tabled text ends the relief from the date the employment relationship ends, and article 304 applies it from tax year 2021.[S1]

## What we don't know yet

- The final text. We read the bill as tabled on 26 October 2026, and only the end of the new paragraph 5 of article 5Γ: points (β) and (γ), not point (α) or the opening words. The text passed on 5 November 2026 may include technical changes.
- The law number and the date of publication in the Government Gazette (ΦΕΚ). The bill is not law until it is published.
- Whether applying points (β) and (γ) from tax year 2021 means ΑΑΔΕ can claim back tax for past years from people whose job ended or who moved abroad, and whether interest or surcharges would apply.
- How ΑΑΔΕ, the tax authority, will apply the new rules: whether it will issue a circular or amend its decisions on 5Γ, and how it will treat the self-employed, since point (β) refers to the end of an employment relationship.
- When the 15% pension tax starts. Ta Nea reports tax year 2027; we did not find a start date for it in the parts of the tabled text we read. Which organisations qualify is also not confirmed.
