# The EU is talking about a windfall tax on energy firms again, with no proposal yet. Greece says it already taxed refiners in 2022 and 2023

EU finance ministers asked the Commission on 9 October 2026 only to explore a windfall tax on energy companies, and Greece was not among the countries that had asked for one, according to Greek press reports; its finance ministry says refiners were already taxed in 2022 and 2023 and a new levy would not lower pump prices now.

## At a glance

- We found no Greek government bill, amendment or decision for a new windfall tax on energy companies in 2026; on 22 September 2026 the Ministry of National Economy and Finance argued against a new refinery levy now.
- At EU level, finance ministers asked the European Commission on 9 October 2026 to explore an EU-wide windfall tax; there is no legislative proposal or timeline, and Greece was not among the six countries that asked for one, according to Dnews.
- Greece used three separate tools in 2022–23: a 90% one-off levy on power producers (€367.07 million assessed), a clawback of day-ahead power market revenues (€2.57 billion collected from July to November 2022) and two 33% solidarity contributions that fell on refiners and other fossil-fuel companies.

The European Union is talking again about taxing energy companies' windfall profits, but Greece is not proposing a new tax of its own.[S1][S6] The Greek government's position, set out on 22 September 2026, is that it already taxed refiners' excess profits in 2022 and 2023 and that a new levy now would not bring down fuel prices.[S1]

## What did the EU agree on 9 October 2026?

EU finance ministers meeting in Luxembourg on 9 October 2026 asked the European Commission to explore an EU-wide tax on energy companies' windfall profits, according to press reports.[S6][S8] The Commission told ministers it would examine the feasibility and economic impact of such a tax, To Vima and Ta Nea reported, both citing Bloomberg.[S4][S22] The current price shock follows the war involving Iran and disruption at the Strait of Hormuz.[S7][S8]

Commissioner Valdis Dombrovskis announced a working group to "share best practice and assist Member States" and said member states are "best placed" to act in this area, Agence Europe reported; Eunews quoted him as saying member states are "in a better position to set taxes".[S6][S7] No timeline was given, and there is no legislative proposal.[S6][S7][S8]

Germany, Portugal, Spain, Austria, Italy and Poland had asked the EU for such a proposal in a letter earlier in the year, To Vima and Ta Nea reported; Greece was not among them, Dnews reported on 9 October 2026.[S4][S22][S5] Energy Commissioner Dan Jørgensen opposed a single EU-wide tax, Dnews reported.[S5] Wopke Hoekstra, the commissioner responsible for taxation, acknowledged that such a tax involves complications because several member states still disagree, To Vima and Ta Nea reported, citing Bloomberg,[S4][S22] and pointed to "legal battles" over the EU's 2022 solidarity contribution, according to Agence Europe.[S7] Kyriakos Pierrakakis, Greece's finance minister and President of the Eurogroup, said at the meeting that citizens must be protected from high energy prices "without sending the wrong fiscal signals", Eunews reported.[S8]

## Why does the Greek government say no to a new levy?

Greece's finance ministry, the Υπουργείο Εθνικής Οικονομίας και Οικονομικών (Ypourgeio Ethnikis Oikonomias kai Oikonomikon), set out its position on 22 September 2026 in a statement titled "The easy pledges of ELAS and the hard reality".[S1] The ministry said the government had already taxed refineries' excess profits in 2022 and 2023, so there is "no question of principle" about taxing them, in our translation.[S1]

It also made an argument about timing: the ministry said profits from the current period will be settled for tax in July 2027.[S1]

> "A tax that will be collected tomorrow does not lower the price at the pump today," the Greek finance ministry said on 22 September 2026 (in our translation).[S1]

The ministry also said Greek refineries already give discounts of more than €30 million a month and have provided €87 million since mid-July 2026.[S1][S3] It argued that a levy imposed by Greece alone would weaken Greek refineries against competitors across the Mediterranean.[S1] It said petroleum products were Greece's largest export category in 2025, worth about €10.4 billion.[S1]

## Who in Greece wants a windfall tax?

The ministry's statement answered ΕΛΑΣ (ELAS), the Ελληνική Αριστερή Συμπαράταξη (Elliniki Aristeri Symparataxi, Greek Left Alliance — our rendering), the new party of former prime minister Alexis Tsipras.[S1][S2] Tsipras announced the party's name on 26 May 2026, Ta Nea reported.[S24] In a video message on 22 September 2026, Tsipras called for an emergency tax on refineries' windfall profits, plus price caps of €1.4 a litre for heating oil and €1.8 a litre for diesel.[S1][S2][S19] ELAS put refiners' first-half 2026 profits at €1.998 billion, of which it classed €1.278 billion as windfall profits, and estimated that an emergency tax would raise €400–800 million; these are the party's own figures.[S2][S19] Government spokesman Pavlos Marinakis mocked the proposals as "an old trick" of saying what people want to hear from a safe position, according to ieidiseis.gr (in our translation).[S2]

SYRIZA tabled an amendment on 23 September 2026 for a one-year ceiling on gross profit margins in oil refining, set at the average of documented refining margins in the EU, aftodioikisi.gr reported.[S20] That is a cap on margins, not a windfall tax, and we found no record of what happened to it.[S20]

## What did Greece take from energy companies in 2022 and 2023?

Greece used three separate tools in 2022–23, each with its own legal basis.[S9][S13][S14]

| Tool | Who paid | Legal basis | Period | Amount |
|---|---|---|---|---|
| One-off 90% levy | Electricity producers | Article 37, law 4936/2022[S9] | 1 Oct 2021 – 30 Jun 2022[S9] | €367,067,027.54 assessed[S11][S12] |
| Day-ahead market clawback | Electricity producers | Article 122, law 4951/2022 (new article 12Α of law 4425/2016)[S13] | 1 Jul 2022 – 1 Jun 2023[S13] | €2,568,412,721.83 collected, Jul–Nov 2022[S11][S12] |
| 33% solidarity contribution | Refiners and other fossil-fuel firms | Article 114, law 5007/2022 (tax year 2022); article 14, law 5122/2024 (tax year 2023)[S14][S17][S23] | Tax years 2022 and 2023[S14][S15] | 2023: net revenue estimated at €300 million (ministry)[S16] |

**The 90% levy.** Article 37 of law 4936/2022, the National Climate Law, imposed a one-off extraordinary levy (έκτακτη εισφορά, ektakti eisfora) of 90% on the increase in electricity producers' gross profit margin (μικτό περιθώριο κέρδους) between 1 October 2021 and 30 June 2022.[S9][S23] Then finance minister Staikouras said on 1 December 2022 that €367,067,027.54 had been assessed, payable by 30 December 2022.[S11][S12]

**The clawback.** Article 122 of law 4951/2022 created a Temporary Mechanism for Returning Part of Day-Ahead Market Revenues (Προσωρινός Μηχανισμός Επιστροφής Μέρους Εσόδων Αγοράς Επόμενης Ημέρας), which ran from 1 July 2022 to 1 June 2023.[S13] Under it, producers had to return the difference between the market clearing price and an administratively set price for their technology.[S13] The money went to the Energy Transition Fund (Ταμείο Ενεργειακής Μετάβασης, Tameio Energeiakis Metavasis).[S13] Staikouras said €2,568,412,721.83 had been collected this way from July to the end of November 2022.[S11][S12]

**The refinery contributions.** Article 114 of law 5007/2022 applied the EU's temporary solidarity contribution (Προσωρινή Συνεισφορά Αλληλεγγύης, Prosorini Syneisfora Allilengyis), under article 14 of Council Regulation (EU) 2022/1854, at 33% for tax year 2022 to companies earning at least 75% of their revenue from oil, gas, coal or lignite extraction, coke or refining.[S14] The base is taxable profits above 120% of the 2018–2021 average.[S14][S15][S17] In June 2024 the ministry announced a second 33% contribution on refiners' tax-year 2023 excess profits, "following" the first, in our translation.[S15] It was enacted by article 14 of law 5122/2024.[S17][S23] A decision of ΑΑΔΕ (AADE; Ανεξάρτητη Αρχή Δημοσίων Εσόδων, Anexartiti Archi Dimosion Esodon), the Independent Authority for Public Revenue, Greece's tax authority, numbered Α.1141/2024, set a declaration deadline of 30 September 2024 and a single payment by 28 February 2025.[S16][S17] The ministry estimated net revenue at €300 million, earmarked for a December payment to pensioners who would not receive the 2025 pension rise and for the Public Investment Programme.[S15][S16]

## What did the courts say about the 90% levy?

The Συμβούλιο της Επικρατείας (Symvoulio tis Epikrateias, ΣτΕ), the Council of State, Greece's supreme administrative court, ruled in decision 188/2024 of 29 March 2024 that the 90% levy is constitutional.[S10][S21] It held that the levy does not constitute a tax (in our translation).[S10] The court found no breach of article 5(1) of the Greek Constitution or of article 1 of Protocol 1 of the European Convention on Human Rights.[S10]

## What we checked

- **missing**: ΕΛΑΣ says an emergency tax on refinery windfall profits would raise €400–800 million.[S19] → This is the party's own estimate, reported in two articles from the same outlet; neither sets out how the range was calculated, and we found no published calculation.[S2][S19]
- **confirmed**: The finance ministry said on 22 September 2026 that the government had already taxed refineries' excess profits in 2022 and 2023.[S1] → Article 114 of law 5007/2022 imposed a 33% solidarity contribution for tax year 2022,[S14] and article 14 of law 5122/2024 imposed a second one on tax-year 2023 profits.[S17][S23]

## What we don't know yet

- Whether Greece will support, abstain from or oppose any EU-level windfall tax if the Commission's working group produces options. We found no Greek government statement on this after 9 October 2026 beyond Finance Minister Pierrakakis's general remark at the meeting.
- What the Commission's working group will cover, who sits on it and when it will report. No timeline was given.
- How much the 33% solidarity contribution on refiners' 2023 profits actually raised. The finance ministry estimated net revenue at €300 million in July 2024; we found no official outturn figure.
- What happened to SYRIZA's amendment of 23 September 2026 for a cap on refining margins: we found no record of whether it was rejected, withdrawn or not admitted.
- On what legal footing refiners give the discounts the ministry cited (over €30 million a month since mid-July 2026), and whether they will continue. We found no document.
